This law is the "Law on the Establishment of the Independent National Electoral and Boundary Commission of the Federal Republic of Somalia."
The primary objectives of this law are:
1. To establish an Independent National Electoral and Boundary Commission that is a constitutional body, independent, impartial, and accountable to the Federal Parliament of Somalia.
2. To define the powers and responsibilities of the Commission related to the organization, management, supervision, and announcement of election and referendum results at various levels, including local districts, federal member states, Banadir region, and the national level.
3. To regulate the delimitation of electoral boundaries and administrative boundaries within Somalia, ensuring they are drawn fairly and with consideration of past boundaries, territorial integrity, and socio-political factors.
The law emphasizes principles of democracy, federalism, political rights protection for all citizens, and guarantees that elections are free, fair, transparent, and conducted without interference such as fraud, corruption, coercion, or intimidation.
The Commission is tasked with managing voter registration, candidate and political party regulation, conflict resolution in elections, enforcing electoral codes of conduct, and facilitating public participation with equitable representation.
Additionally, the law covers the Commission’s structure, member qualifications, appointment process, tenure, ethical standards, budget management, and operational procedures to ensure its effective, impartial, and accountable functioning.
The Commission also has the authority to draft electoral regulations, oversee election security, accredit domestic and international observers, and provide recommendations to Parliament regarding delimitation and related electoral matters.
This law is key for ensuring credible, inclusive, and well-organized elections, strengthening Somalia’s democratic governance and federal unity.
