Summary of the Bill The Federal Government of Somalia, through the Office of the Prime Minister, has formally submitted to the House of the People the African Charter on the Rights and Welfare of the Child (ACRWC) for ratification. This Charter, adopted by the African Union, aims to protect the dignity, survival, development, and rights of every child in Africa. It requires member states to enact legislative and policy measures that guarantee children’s education, health, and protection from violence, exploitation, and discrimination. The Council of Ministers, in its meeting No. SHGW.41.99.11.24 of 25 November 2024, unanimously approved the Charter, with certain reservations proposed by the Somali Government. These reservations apply to articles that may conflict with Somalia’s Islamic principles and social values, specifically: 1. Article 2 – Definition of a Child 2. Article 9 – Freedom of Thought, Conscience and Religion 3. Article 10 – Protection of Privacy 4. Article 21(2) – Child Marriage and Betrothal 5. Article 24 – Adoption The ratification of this Charter demonstrates Somalia’s continued commitment to children’s rights and welfare, in line with the Provisional Constitution of Somalia (2012), which guarantees every child’s right to life, protection, education, and dignity. It also aligns Somalia with international conventions such as the UN Convention on the Rights of the Child (CRC), strengthening the country’s human rights framework and cooperation with regional and global partners.
